AI Usage Policy

This AI Usage Policy (the “AI Usage Policy”) applies to our AI-powered features offered within our Services (together, these features are referred to as the “Headway AI”), including, without limitation, our AI chat features (the “AI-chat”) and other AI-powered features, such as AI-generated results and reports. Before you start interacting with our AI-powered features, please carefully review this AI Usage Policy, which is an integral part of our Terms and Conditions of Use. We reserve the right to modify this AI Usage Policy at our discretion from time to time, to the extent permitted or required by applicable law.

Any translation from the English version is provided for your convenience only. The original English text shall be the sole legally binding version.

By accessing or using any of our AI-powered features, you acknowledge that you have read, understood, and agree to be bound by this AI Usage Policy. IF YOU DO NOT AGREE WITH ANY PART OF THIS AI USAGE POLICY, OR IF YOU ARE NOT ELIGIBLE OR AUTHORIZED TO BE BOUND BY THIS AI USAGE POLICY, THEN DO NOT INTERACT WITH HEADWAY AI.

We rely on third-party service providers to enable Headway AI. Please note that certain features may not be available on your device due to technical requirements or limitations related to local processing or compatibility.

1. Your Use of Headway AI

Our AI-powered features are provided “as is”. We do not guarantee the accuracy, quality, completeness, reliability, suitability, availability, or performance of these features or any resulting output, nor do we guarantee your satisfaction with the relevant feature.

You acknowledge and agree that:

You are solely responsible for how you use the AI-generated outputs.
AI-generated outputs may contain inaccuracies, errors, or biases. You should use them with caution and apply your own judgment and critical thinking.
Headway AI may not cover every possible scenario or question. Its capabilities are focused on our Services, and you are encouraged to use Headway AI within its intended scope.
We are not liable for any impact these features may have on your personal or professional life, including decisions, outcomes, or emotional responses resulting from your use of the AI-generated outputs.
You are solely responsible for the data and content you submit to Headway AI and how you use the outputs. You acknowledge and agree that your use of the AI-powered features will comply with all applicable laws and regulations, our Terms and Conditions of Use, and any other applicable Headway agreements and policies, third-party policies as may be applicable, and will not infringe upon, violate, or misappropriate any of Headway’s rights or the rights of any third party.

Accuracy, Biases, and Hallucinations: AI models are complex and constantly evolving. Headway AI is developed to provide information based on its most up-to-date knowledge. While we make every effort to ensure the accuracy of the information provided, users should be aware that Headway AI may not always reflect the most current developments, news, or changes. Users are encouraged to independently verify critical information from reliable sources. Headway AI is not a substitute for professional advice, and users should consult relevant experts or authorities for specific and crucial matters. If Headway AI provides information that seems unclear or contradictory, please exercise caution and seek clarification from appropriate sources. You are responsible for validating information obtained through Headway AI, understanding its limitations, and using its judgments accordingly.

You should be aware that:

AI models can sometimes generate information that is plausible but incorrect or nonsensical (“hallucinations”).
AI models are trained on vast datasets, which may reflect societal biases present in the training data. Therefore, outputs may be biased or unfair.
The information provided by AI may not always be up-to-date, complete, or entirely accurate. It should not be considered a substitute for verified facts or professional advice.

2. Specific Rules for AI-Chat

Purpose: The AI-chat feature is designed to provide an engaging and interactive experience. It allows you to explore topics, practice communication, and enhance your learning journey

The AI-chat feature is powered by artificial intelligence and is not a human. Any advice, opinions, or information it provides is generated by an AI and should be treated as such. It is not a real person and does not possess genuine emotions, consciousness, or personal experiences.

Data: Please do not share sensitive personal information in the chat (e.g., address, financial details, health data), and share only the information needed for your conversation. We process the personal data you provide as described in our Privacy Policy. We may also analyze the automatically collected information about your interaction with the AI-chat (e.g., frequency of use, feature engagement). This data helps us understand how our features are used, improve their performance, and enhance your overall experience.

Age Restriction: The AI-chat feature is intended for and available only to users who are 18 years of age or older. By using this feature, you confirm that you meet this requirement.

3. Specific Rules for AI-Generated Results and Reports

Purpose: Some of our AI-powered features generate results or reports based on information you provide, such as your answers to a quiz or a photo you choose to upload.

Your content: You must have all rights, consents, and permissions necessary for any data and content you submit to these features. We process this content as described in our Privacy Policy.

Nature of results: AI-generated results and reports are produced automatically and are subject to the disclaimer in Section 6 below.

4. Our AI Providers

No Training: We use third-party AI providers to power our AI-powered features, currently OpenAI, Anthropic (Claude) and Google (Gemini). They process the content you submit in order to generate responses or results for us to return to you. Under the terms of our use of their services, your inputs and outputs are not used to train their AI models. The providers and models we use may change from time to time.

5. Prohibited Use

Headway reserves the right to take appropriate action, including the suspension or termination of Headway AI access, in response to any violation of this AI Usage Policy. We don’t allow the use of Headway AI for the following:

Illegal activity.
Child Sexual Abuse Material or any content that exploits or harms children.
Generation of hateful, harassing, or violent content, including but not limited to promoting hate based on identity; harassing, threatening, or bullying individuals; glorifying or encouraging violence, suffering, or humiliation.
Malware generation, including code designed to disrupt, damage, or gain unauthorized access to a system.
Activity that has a high risk of physical harm, including weapons development; military or warfare use; managing critical infrastructure (energy, transport, water); promoting or depicting self-harm (e.g., suicide, cutting, eating disorders).
Activity that has a high risk of economic harm, including multi-level marketing, gambling, payday lending, automated determinations of eligibility for credit, employment, educational institutions, or public assistance services.
Fraudulent or deceptive activity, including scams, plagiarism, academic dishonesty, disinformation, spam, fake reviews, astroturfing, pseudo-pharmaceuticals.
Adult content, adult industries, and dating apps, including sexually explicit material or services, erotic chat, pornography, content that promotes sexual services (excluding sex education and wellness).
Political campaigning or lobbying, including mass or targeted campaign materials, political chatbots or advocacy tools.
Processing personal data. You shall not provide Headway AI with personal data of any other person, or any confidential information, that you do not have all rights, consents, and permissions necessary to share.
Activity that violates people’s privacy, including tracking or monitoring an individual without their consent; facial recognition of private individuals; classifying individuals based on protected characteristics; using biometrics for identification or assessment; unlawful collection or disclosure of personally identifiable information or educational, financial, or other protected records.
Providing legal advice or practicing law without a qualified review. Headway AI is not a substitute for legal advice.
Offering tailored financial advice without a qualified review. Headway AI is not designed to provide financial advice.
Medical claims or advice, including providing diagnosis, treatment, or triage for health conditions. Headway AI is not intended to provide medical advice or information. You should never use Headway AI to provide diagnostic or treatment services for any medical conditions.
High-risk government decision-making, including law enforcement and criminal justice, migration, and asylum.

6. DISCLAIMER

WE DO NOT OFFER OR PROVIDE ANY KIND OF MEDICAL ADVICE OR OTHER HEALTHCARE SERVICE, INCLUDING WITHOUT LIMITATION, ANY TESTING, DIAGNOSIS, OR EVALUATION RELATED TO MENTAL HEALTH. IF YOU HAVE ANY PROBLEM WITH YOUR HEALTH, YOU SHALL VISIT, CALL, OR CONSULT WITH YOUR PHYSICIAN OR OTHER HEALTHCARE PROFESSIONALS.

THE HEADWAY AI'S RESPONSES ARE FOR INFORMATIONAL PURPOSES ONLY. YOU SHOULD NOT CONSTRUE ANY SUCH INFORMATION OR OTHER MATERIAL AS MEDICAL, LEGAL, TAX, INVESTMENT, FINANCIAL, OR OTHER ADVICE. AI-GENERATED RESULTS AND REPORTS ARE PROVIDED FOR ENTERTAINMENT AND GENERAL INFORMATIONAL PURPOSES ONLY, DO NOT HAVE A SCIENTIFIC BASIS, AND DO NOT CONSTITUTE FACTUAL RESULTS OR PROFESSIONAL ADVICE OF ANY KIND. YOU SHOULD NOT RELY ON THEM.

7. Privacy and Security

Some of our AI-powered features may require you to provide personal data to function, and we process it as described in our Privacy Policy. Please share only the information needed for the feature you are using, and do not share sensitive personal information. Never share passwords or payment credentials with Headway AI. If you encounter any communication that appears to be seeking such information, please report it immediately to support@get-headway.com. Conversations and other interactions with Headway AI may be logged and/or stored beyond the current session.

Users are responsible for ensuring the security of their devices and accounts. Headway is not liable for any unauthorized access or security breaches resulting from the user's failure to maintain the security of their personal information.

8. Limitation of Liability

Headway makes no express or implied warranties, including warranties of merchantability or fitness for a particular purpose, on Headway AI. To the maximum extent permitted by applicable law, Headway, its affiliates, directors, employees, agents, and representatives shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with the use or inability to use Headway AI. We assume no responsibility for any errors, inaccuracies, omissions, or other deficiencies in Headway AI’s responses. Users expressly agree that their use of Headway AI is at their sole risk. We do not warrant that Headway AI will meet user requirements, be uninterrupted, secure, error-free, or that any defects will be corrected. In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not allowed, Headway’s liability is limited to the maximum extent permitted by law. We disclaim any liability for any actions taken or not taken based on the information provided by Headway AI. Users are responsible for independently verifying critical information and making decisions based on their judgment.
